Terms of Use

1. Publisher
The Nelyx App is published by Mr. Kadiata Triven, Sole Proprietor, registered under SIREN 889890141. Contact: support@nelyx.fr.
2. Definitions
In these Terms:
- “Client”: the company that subscribed to a plan.
- “User”: any person with an account on the App.
- “Administrator”: user with extended rights (e.g., CEO, HR Manager).
- “Service”: the Nelyx platform and its related APIs.
3. Purpose
These Terms govern access to and use of the App, dedicated to HR management, leave tracking and team scheduling.
4. Access & Accounts
- Access is restricted to users with a valid account.
- Minimum age: 18 years.
- Each user is responsible for keeping their credentials confidential.
- Sign-in is possible via email/password or OAuth (Google).
5. Main Features
- Leave and absence requests
- Leave balance tracking
- Real-time in-app notifications
- Team planning and scheduling
- Roles & permissions (CEO, HR Manager, Manager, Employee)
- Audit log and traceability
6. Acceptable Use
You must not:
- Share illegal or harassing content
- Perform spam, large-scale scraping or intentional overload
- Attempt to bypass security controls
- Introduce viruses, malicious scripts or other threats
7. Security
Nelyx applies reasonable measures (encryption in transit, backups, logging). The user acknowledges the inherent risks of using the Internet.
8. Billing & Payment
- Billing handled by Nelyx (sole proprietor) via Stripe.
- Monthly or yearly subscriptions with automatic renewal.
- Upgrades/downgrades pro-rated.
- In case of non-payment, access may be suspended after notice.
9. Personal Data (GDPR)
The publisher acts as data controller. Processing activities are described in the Privacy Policy. Users have rights of access, rectification, erasure and portability. Sub-processors include Stripe, Resend, Upstash/Redis, hosting provider.

See the Cookies Policy. Cookies used: authentication, preferences, analytics.
11. Intellectual Property
All content, interfaces, logos and code of the App are the exclusive property of the publisher. Any unauthorised reproduction is prohibited.
12. Availability & Maintenance
Nelyx may carry out planned or urgent maintenance. No uninterrupted availability is guaranteed unless a specific SLA applies.
13. Support
Support is available at support@nelyx.fr. Indicative response time: within 72 business hours.
14. Suspension / Termination
14.1 Grounds
- Non-payment or chargeback
- Serious breach of the Terms (e.g., security, fraud, harassment)
- Confirmed security risk or attempted intrusion
14.2 Effects & Data Export
Upon termination, access to the Service is discontinued. The User/Client may export their data within 30 days from the effective date, unless otherwise required by law.
14.3 Anti-evasion Measures
In case of suspension or permanent ban for serious breach, Nelyx may implement reasonable measures to prevent re-signup or reuse of the Service by the concerned person.
- Maintaining a block list of identifiers (e.g., hashed email, risky domains).
- Analysing strictly necessary technical signals (e.g., truncated IP, User-Agent) and applying rate-limits/quotas at signup.
- Reinforced checks (email/domain validation, multi-account control).
These measures are limited to security and abuse prevention, exclude any marketing purpose, and are implemented in compliance with data protection law. Legal basis: legitimate interest (fraud prevention). Retention periods are specified in the Privacy Policy.
Right to appeal: support@nelyx.fr (or dpo@nelyx.fr for GDPR requests).
15. Limitation of Liability
Liability capped at 3 months of subscription fees. Excludes indirect losses (profit, data, business).
16. Feedback & Suggestions
Any feedback or suggestion sent to Nelyx may be freely used to improve the Service, without obligation of consideration.
17. Changes to the Terms
The Terms may be amended at any time. In case of a major change, a 30-day notice will be sent (email or in-app).
18. Governing Law & Jurisdiction
These Terms are governed by French law. Any dispute shall be submitted to the courts with jurisdiction over Bobigny. The French version prevails.
